This website, dozeband.com, is operated by DozeBand ("we", "us" or "our"). By visiting our site or purchasing from us, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the site.

1. Eligibility

You must be at least the age of majority in your state of residence to make a purchase, or have the consent of a parent or guardian who agrees to these Terms on your behalf.

2. Products and descriptions

We try to display our products, colors and features as accurately as possible. Product images may be illustrative, and colors may vary slightly depending on your screen. If a product is not as described, your remedy is to return it under our Refund Policy.

3. Product use and safety

DozeBand products are consumer audio accessories and are not medical devices. They are not intended to diagnose, treat or cure any sleep disorder or other condition. Keep the volume at a comfortable, safe level. DozeBand Kid is intended for use under adult supervision; do not leave the charging cable with an unattended child, and do not use the product while it is charging. Follow all included care and charging instructions.

4. Pricing, promotions and payment

Prices are listed in US dollars and may change without notice. Promotions and discounts are valid only for the period stated and may not be combined unless stated otherwise. We may refuse or cancel any order, including orders that appear fraudulent or contain a pricing error; if we cancel an order you have paid for, we will refund you in full. Payments are processed securely through Shopify and its payment partners.

5. Shipping, returns and refunds

Shipping is governed by our Shipping Policy, and returns and refunds by our Refund Policy, both of which form part of these Terms.

6. Accounts

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account.

7. Reviews and submissions

If you submit reviews, comments or other content, you confirm it is your own, accurate and lawful, and you grant us a non-exclusive, royalty-free license to use, reproduce and display it in connection with our store and marketing. We may remove content at our discretion.

8. Prohibited uses

You may not use the site for any unlawful purpose, to infringe anyone's rights, to transmit malicious code, to interfere with the site's security, or to scrape or copy our content without permission.

9. Intellectual property

All content on this site, including text, graphics, logos and images, is owned by or licensed to DozeBand and may not be used without our written permission.

Our site uses third-party services such as Shopify, payment processors and shipping carriers. Your use of those services may be subject to their own terms. We are not responsible for third-party websites linked from our site.

Except as expressly stated in our Refund Policy and to the fullest extent permitted by law, the site and our products are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability and fitness for a particular purpose.

12. Limitation of liability

To the fullest extent permitted by law, DozeBand will not be liable for any indirect, incidental, special or consequential damages arising from your use of the site or our products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Some states do not allow these limitations, so they may not apply to you.
